Please refer to these terms and conditions governing your visit, access, viewing and use in any way on ABIS's website as well as the services offered by the company. You should know that visiting and using this website requires you to familiarize yourself with these terms and to accept them. These terms and conditions apply automatically on initial access to the website and are binding on a contractual agreement applicable to all versions of the website, whether using it on a computer or a mobile device.

Terms

For the purposes of these Terms and Conditions, the following terms and concepts are used with the following meanings:

  • Website - all information, all author images, designs, texts and other materials or resources found at https://www.abis.bg/ and the subdomains at the same address.
  • Page - each separate and inseparable part of the website and the subsequent domain name.
  • Link - a text object or a button on a page that allows forwarding to another page or object.
  • User - any physical or legal entity that uses any of the services on the site or has visited it, regardless of when it happened 
  • IP Address - a unique ID number that provides the location of website visitors.
  • Force majeure event - unforeseen, at the time of drafting the current general conditions, circumstance of extraordinary nature, which renders the provision of services objectively impossible.
  • Malicious attacks - acts or omissions of third parties that are contrary to the rules of Internet ethics, including but not limited to DoS (Denial of Service), unsolicited mail, flood, access to resources with foreign rights and passwords, use of systems deficiencies for the purpose of own gaining or obtaining information, carrying out actions that can be qualified as industrial espionage or sabotage, damage to or destruction of systems or information patterns, sending viruses or causing virus installation or remote control systems, disturbing the normal work of other website users and the website itself.

Applicability

Terms of use apply equally to registered and unregistered users. The Terms and Conditions do not deal with, nor regulate any matter arising from, or relating to the provision of links to other third-party websites, ads, and software. The Administrator is not responsible for the accuracy and completeness of the content of the sites to which the Website refers. 

The Terms of Use shall be enforced from the moment the User first accesses the Website. These are applicable to the first and each subsequent visit and use of the Services and resources of the Website and are valid until the use of the Website is terminated. The user is responsible for their actions in connection with the use of the Website even after the termination of its use.

Terms of Use may be changed or updated periodically at the discretion of the Administrator for which the User will be notified. Unless expressly stated otherwise, the changes will take effect from the day of their publication on the Website. If you do not agree with the changes made or are not satisfied with the services offered, you may at any time discontinue your use of the Website. 

Access to the Website and the use of the Services is considered to be a consent of the User with these Terms of Use. By signing up to this Website, registering to receive ad notifications electronically (newsletter) and sending a request through the Website, the user expresses its explicit and informed consent to these Terms of Use, the Privacy Policy, and the Cookie Policy of the Administrator posted on the Website.

 

Services and Content

The Services available on the Website for User Use include, but is not limited to, the following listed options:

  • View the Content on the Website.
  • Examining the services offered by ABIS Ltd.
  • Browse special offers / promotional campaigns of ABIS Ltd.
  • Contacting ABIS Ltd by contacting or completing an electronic inquiry. 
  • Each user of the services offered by ABIS Ltd can register on the platform to obtain information about the status and progress of the assigned order, additional information related to it, or information about completed and pending payments. Registration can only be made through a customer number that is obtained upon signing a contract.
  • Each user of the platform can subscribe to receiving ad notifications, news, tips or other information electronically (newsletter).

At the discretion of the Administrator, Services and Special Offers may be updated, modified, supplemented, expanded or narrowed, and discontinued at any time. The User utilises the Services and the Website at his / her own risk and responsibility in regards to the compliance of the services with his / her ideas and expectations.

Access

The Services on the Website are intended for Consumers as well as legal entities and organizations established and/or operating in accordance with Bulgarian law. By accessing the Website and accepting these Terms of Use, the User declares that he is of full age and complies with these terms and conditions.

Users who access the Website from other territories outside of Bulgaria are responsible for their actions in accordance with all applicable local laws in the territory from which the Website is accessed.

The Administrator reserves the right to refuse access to the Services or to reject a User's request to create a registration in the event that the information specified by the User is incorrect, inaccurate, incomplete, the user has no contractual relationship with the Administrator, or in other cases, based on his judgment.

A user profile may be blocked or its functionality restricted if, at the discretion of the Administrator or by data of investigating and judicial authorities, it is established or is in the process of establishing that this Account has been or is being committed in connection with the Services or if the User has committed or has engaged in any activity that is unlawful or in violation of these Terms of Use and their appendices and/or damages the rights, freedoms and legitimate interests of the Administrator, users, or third parties.

Access to Services should not be considered or interpreted in any way as royalty-free licensing or property rights, including copyrights or other intellectual and industrial property rights.

When creating a user account, the user has the opportunity to express his informed consent to receive any advertising messages and notifications in the mobile versions of the Website, newsletters, campaigns and any other messages, including SMS, sent by the Administrator to the user's email address registered by the User and a phone number.

All rights, property and legitimate interests on the Website or in connection with the System, Platform, or Workflow that drive it and which are not explicitly listed in these Terms of Use belong to the Administrator.

Using the Platform requires Internet access, including a browser program or mobile application.

Deleting the User Profile can be done through the features available in the My Account menu, the Settings tab, the Delete submenu.

Rights and obligations of the User

The user has the right to register a user profile and use the services legally on the Website in accordance with these Terms of Use. The user may terminate the use of the Services at any time and request the deletion of his or her account.

The user is required:

  • To access the Website through the technologies and resources provided in it, realized through the normal functionality of the Website and to use it legally, according to its purpose and in accordance with these Terms of Use.
  • Not to reproduce, copy, duplicate, modify, create derivative or customized, entire or separate parts of the Website or System that drive it and not provide in any form or by any other means, whether commercial or non-commercial purpose, any information, content, user data, technology or know-how derived in whole or in part from the Website, including its mobile versions and applications.
  • Not to upset the full or partial functionality of the Website, to overload traffic, and not to generate excessive traffic, to attempt to gain unauthorized access to any part of the Website or to the relevant computer systems, servers or network supported by the Administrator or related to it.
  • To keep secret your email address and password on the Website, not use the accounts of other users, or provide your account for use by others.
  • Not to violate the privacy of other users of the Website by collecting, storing, and distributing information to other users, except when these actions are legally compliant.
  • Not to use the trademark of ABIS Ltd., including similar or similar domains with ABIS and other trademarks registered by ABIS Ltd., and not to infringe any other intellectual property rights of the Administrator and its affiliates, partners or its lawyers in accordance with the provisions of these Terms of Use.

Rights and obligations of the Administrator

The administrator is entitled:

To block User access to his / her account and/or the entire Website, as well as removing his / her account without obligation to notify or to state reasons in the following, non-exhaustively listed cases:

  • The User violates these Terms of Use or the applicable law;
  • The user harms the interests of other users, the Administrator or third parties;
  • The administrator has received an injunction from judicial or investigative bodies;
  • In the course of, experience or real danger of the User or persons using his / her profile committing any illegal acts or actions that endanger the security and functioning of the Website and/or the System that drives it.

To allow or deny the creation of a new User Profile of a User who has already been blocked, restricted, or deleted by the Administrator Profile.

To make changes to the Website and Services in connection with maintaining, developing or improving the quality of the Services, expanding or narrowing the scope of the Services at any time, at its sole discretion and without obligation to state reasons for its commercial decisions. The Administrator may, in its sole discretion, provide bonuses, incentives, and other incentives to selected categories of users in relation to campaigns. The administrator is entitled without prior notice to change the prices of certain categories of paid services for a limited period depending on the market situation of the respective services in order to optimize the prices and align them with the current market prices.

To organize promotions, offers, games, polls, surveys to improve the quality of the Services they provide.

The administrator is not responsible for:

Actions by users and third parties that constitute a violation of these Terms of Use and for damages caused by inaccurate, unreliable or misleading information by users of the Website and third parties.

Any posts on or off the Website that are not created by the Administrator itself.

The administrator does not provide guarantees for:

Keeping the website unlimited in time and/or remain unchanged in terms of its appearance and features.

Intelectual property

The User accepts and agrees that the content of the Website, other than User Content, including but not limited to: texts, software, codes, graphics, pictures, sounds, music, videos, interactive features and the like ("Content" trademarks, registered and unregistered designs are owned by ABIS Ltd. or licensed by the respective copyright holders and are protected by copyright and other intellectual property rights. In connection with the provision of the Services, the Website may contain certain third-party intellectual property objects. The use of these objects may be subject to a license agreement entered into between these third parties and ABIS Ltd. The User undertakes not to perform any actions consisting of reverse engineering, decompilation or otherwise separating these objects, and no part of the present Terms of use should not be construed as granting rights in connection with these objects. The Content and Services of the Website are provided as they are solely for information and personal use of the user and can not be used, copied, reproduced, distributed, shared, broadcast, depicted, sold or otherwise used for any without the explicit prior written consent of the respective holder. ABIS Ltd. reserves all rights to the Website and the Content. Users undertake not to take any action relating to the use, copying or distribution of any part of the Content unless expressly agreed to, including any use, copying and distribution of the Third Party Content received through the Website for any commercial purpose. Any actions to reproduce, modify, create derivative works, retrieve the Content in whole or in part, including but not limited to scraping or other forms of data extraction and/or transmitting the Content of the Website to other sources as well as compilations are expressly forbidden. The copying or reproduction of the Website, Content, or any part thereof for future reproduction or use is expressly prohibited.

Compensation

Consumers indemnify and compensate ABIS EOOD, its employees, subsidiaries, affiliates, assignors, agents, service providers in connection with any claims, claims, damages, pecuniary sanctions, liabilities, losses, costs or legal costs arising from:

  • Violation of any provision of these Terms of Use or the applicable law;
  • Violation of third party rights, including, but not limited to, intellectual property rights, trademarks, trade secrets or other proprietary or confidential rights;
  • Any complaint containing allegations that the content posted by the consumer has caused harm to a third party.

Liability and Compensation for Liability apply also to the change of these Terms of Use, as well as to termination and termination of use of the Services and the Website by the User.

Messages and notices

In the process of registration and at any time thereafter, the User has the opportunity to express his / her explicit consent to obtaining marketing communication, offers and advice from the Administrator and his / her partners.

The user has the right to withdraw his / her consent to receive marketing communication, offers and advice from the Administrator and his / her partners at any time through the settings of his / her profile on the Website.

It is possible that in the process of using the Website, the User receives notifications about his actions related to an already registered profile, changes made to him/her or a response to a request for a question.

Confidentiality

Use of this Website and Services of ABIS Ltd. is deemed to be expressed by the User agreeing that his or her personal data be collected, processed and stored by the Administrator for the purpose of proper, trouble-free and full use of the Website under the Terms of Service, Cookies Policy and the privacy, publication, and permanently accessible from the bottom of each page of the Website.

The administrator shall take measures for the protection of the personal data of the users in compliance with the requirements of the Personal Data Protection Act and other applicable provisions of Bulgarian and European law.

The User agrees to receive system information and messages from the Administrator in connection with the use of the Website and the System that drives it, including but not limited to:

  • Changes to the Terms of Service and their appendices and applicable law;
  • Changes in the type and characteristics of the Services;
  • Price changes;
  • Other Changes Affecting Essential User Rights.

Upon reasonable doubt by the Administrator for violating the Terms of Use of the Website, the applicable laws or the disclosure of a crime or the prevention of an infringement, the Administrator has the right to access the shared personal data from the users.

Disputes

Provided that the services on the Website are not fulfilled or are not met in accordance with the provisions of the Terms of Use, the User has the right to file a complaint in electronic form via the contact form or by letter in paper form addressed to the Administrator's postal address. The complaint must contain at least the name of the User, the email address indicated in his account, if available, his postal address and a description of the respective irregularity.

The appeal shall be filed within a maximum of 14 days following the occurrence of the relevant ground. The administrator may refuse to examine complaints submitted after the expiration of this period or not complying with the above requirements.

If the data or information in the complaint is inadequate, the Administrator may contact the User before taking an opinion on the complaint to fill in the missing data and relevant information.

The administrator shall review the complaint within 14 days of the date of receipt of the complaint. A response to the complaint shall be sent to the email address or postal address from which the complainant has sent the complaint.

The above procedure also applies to any other third party complaints sent to the Administrator in connection with the Website. For any questions that need further clarification or are not covered by these Terms of Use, the User may contact the Administrator via the contact form.

For all issues not covered by these Terms of Use, the applicable Bulgarian legislation applies. Disputes concerning the use of the Website and the System that drive it, which can not be resolved by mutual agreement or alternative dispute resolution, which you can find on the website of the Commission for Consumer Protection at www.kzp.bg, will be referred to the competent Bulgarian court.

Additional terms

The User acknowledges and accepts that ABIS Ltd is not responsible for the deletion or inability to store the content on the Website. The User agrees that ABIS Ltd reserves the right at any time to modify or terminate the Service (or any part thereof) with or without notice and ABIS Ltd shall not be liable to Users or third parties for such modification or termination of the Service. The User accepts and agrees that ABIS Ltd, in its sole discretion, has the right (but not the obligation) to delete or deactivate its profile, block its email or IP address, or otherwise terminate user access or use of the Service (or of a portion of it) immediately and without notice and to remove any content in the Service in violation of the Terms of Use, the related apps, the Privacy Policy and applicable law, and the legitimate interests of the Administrator on the part of betel.

The User accepts and agrees that the use of the Website and the Service is entirely at his sole discretion and that the Website and the Service are provided as such without warranty of any kind. Any express and implied warranties, including, but not limited to, warranties of market realization, profitability, fitness for a particular purpose, non-infringement of third party rights are expressly excluded as far as permitted by law. ABIS Ltd assumes no liability or guarantees exceeding the statutory minimum regarding the accuracy and completeness of the content of the Website or the content of any third party website associated with the Website and assumes no responsibility for:

  • Mistakes or inaccuracies in the content;
  • Suffered material or non-material damages of any kind resulting from access to and use of the Website and the Service;
  • Any unauthorized access to or use of the Services and/or any personal or financial information stored therein;
  • Any breaches or interruptions in the link to the Website;
  • Any bugs, viruses, Trojans, or the like that may be transmitted to or through the Third Party Website;
  • Any errors or omissions in content or losses or damages resulting from content posted, sent by email, communicated, broadcast or otherwise made available on the Website.

Under no circumstances will ABIS Ltd, its officers, directors or agents assume any liability for any direct, indirect, incidental, special, consequential or other damages beyond the statutory minimum (even if there is a warning from ABIS Ltd about the possibility of such damages occurring); in any way arising out of the use of the Website or the Service, including, but not limited to, when such damages are arising from the proper or improper use of the Website or the Service, the inability to use Websites or services as well as interruption, suspension, modification or termination of the Website or Service. This limitation of liability should also apply to damages incurred as a result of other services or products received through or advertised in connection with the Website or the Service or through links on the Website and as a result of received information, or advice provided through or advertised in connection with the Website or the Service, or any links on the Website itself. The user understands and accepts that ABIS Ltd is not responsible for user publications or defamatory, offensive or illegal actions by other users or third parties and that the risk of damages resulting from the abovementioned is entirely borne by the User. ABIS Ltd does not give any guarantee that the Website is suitable for use in other territories. Those users who access the Website from other jurisdictions act on their own responsibility and risk and are responsible for compliance with local law.

The rights that these Terms of Use provide to users may not be transferred by them to third parties.
